This writ petition is filed for a writ of mandamus declaring the action of the respondent Nos. 2 and 3 in not allotting the essential commodities to the petitioner’s fair price shop, as illegal and arbitrary and for a consequential direction to respondent Nos.2 and 3 to allot the essential commodities to the petitioner’s shop.

The case of the petitioner is that she was appointed as temporary fair price shop dealer of shop of Pothulakunta Village, Kothacheruvu Mandal, Anantapur District vide proceedings dated 05.09.2012, till the said vacancy is filled up on regular basis. While so, the respondents stopped supplying stocks to the petitioner’s shop for distribution to the card holders without accepting D.D. submitted by the petitioner for release of the stocks. Aggrieved by the same, the present writ petition is filed.

Learned counsel for the petitioner submits that the respondent authorities are not accepting D.D. for release of the stocks.

Learned Assistant Government Pleader for Civil Supplies submits that the petitioner has not remitted D.D. in time for release of the stocks.

In this case, admittedly, petitioner was appointed as fair price shop dealer of Pothulakunta Village, Kothacheruvu Mandal, Anantapur District vide proceedings dated 05.09.2012 on temporary basis till the vacancy is filled up on regular basis and her appointment is in force as on today. In view of the same, there shall be a direction to the respondent authorities to supply the stocks to the petitioner by accepting D.D as long as her appointment is in force or till vacancy is filled up on regular basis, whichever is earlier. However, this will not preclude the competent authority from taking action against the

petitioner in case, the petitioner commits any violation.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
