Heard the learned Counsel for the petitioner and none appeared for the second respondent and other respondents.

This Writ Petition was filed challenging the inaction of respondent Nos.2 and 3 in taking action on the representation dated 22.09.2008 submitted by the petitioner.

The petitioner, along with others, submitted the above representation to the second respondent stating that the fourth respondent, who is the resident of the 1^st street, is making certain constructions by encroaching the road margin. Though a caveat was filed in the Court of the learned Junior Civil Judge, Badvel, and notices were sent to the fourth respondent, the fourth respondent was going ahead with the construction.

Even after six years, no counter affidavit is filed by the respondents and learned Counsel for the petitioner submits that the construction made by the fourth respondent was completed.

In the circumstances, this Writ Petition is disposed of directing the second respondent to inspect the constructions made by respondent Nos.4 and 5 and see whether the constructions are in accordance with the sanctioned plan or not and take necessary action if there are any violations in accordance with the provisions of the Andhra Pradesh Municipalities Act, within a period of three months from the date of receipt of a copy of this order.

The Writ Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
