ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare appearing for the respondents.

Petitioner, who claims to be the person interested in the Masjid-eRahmat-E-Alam at Premises No.8-2-609/1/1/A, seeks permission of the Board for erecting minarets over the said Mosque at his cost. Petitioner is not the Mutawali. However, in his representation dated 20.01.2014, addressed to the Special Officer, he requests that in the interest of the Community it is necessary to construct minarets over the said Mosque and that he is prepared to undertake the expenditure towards the same. Alleging that no action is taken on the said representation in spite of the reminder, dated 22.03.2014, the present writ petition is filed.

Learned standing counsel for the Board states that petitioner’s request would be considered by the Special Officer expeditiously.

In view of that, the writ petition is disposed of directing respondent No.2-Board to consider the petitioner’s aforesaid request after obtaining views from the Mutawali or any other person, as required under the Act, and pass appropriate orders expeditiously preferably within two months from the date of receipt of a copy of this order. Miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
