7. It is not in dispute before this Court that the applicants, though figured in the seniority list of 1978, did not approach the Tribunal at any point of time. However, they were appointed temporarily under Rule 10(a)(1)(i) of the Andhra Pradesh State and Subordinate Service Rules, 1996 (for short, “the Rules”) on 10.8.1978 as Assistant Executive Engineers. It is also not in dispute before this Court that on 26.4.1984, their services in that category were regularized in terms of G.O.Ms.No.647, dated 14.9.1979. It is also not in dispute before this Court that the Engineer-in-Chief (R&B), Errummanzil, A.P., Hyderabad, in Circular Memo No.18693/Ser.V(1)/1995, dated 19.10.2008, prepared a zone-wise provisional seniority list of Assistant Executive Engineers (R&B) of Zone-I to Zone-VI and City Cadre in Annexure-I after considering all the aspects and also after calling for objections. It is specifically mentioned that Assistant Executive Engineer, R & B appointed prior to 9.8.1979 are regularized under G.O.Ms.No.647, dated 14.9.1979. The final seniority list is not under challenge thereafter though it was put in the web site. It is not the case of the applicants that they were not aware of this final seniority list. No doubt, in the first instance, the applicants have to get an order of reallocation to R & B Department, as they were allotted to the Irrigation Department by A.P.P.S.C., as contemplated under Rule 4(c) of the Rules. Though a representation was made by the applicants for reallocation, that was rejected by the Government through a memo impugned before the Tribunal vide Memo No.3311/Ser.II(1)/2008-1, dated 10.4.2008. Though this memo was under challenge before the Tribunal, no finding of whatsoever was given by the Tribunal in this regard, instead, granted the relief to the effect that the applicants are entitled to be treated as candidates of A.P.P.S.C., selected in 1978
