The petitioner earlier instituted W.P.No.10146 of 2014 challenging the order of the Indian Railway Catering and Tourism Corporation, New Delhi (1^st respondent), dated 25.03.2014. Considering the submissions made, the writ petition was disposed of by order, dated 03.04.2014, giving liberty to the petitioner to submit his explanation treating the order, dated 25.03.2014, as show cause notice within a period of one week and on submission of such explanation, the respondent Corporation was directed to pass further orders within two weeks. It was represented that fresh tenders were called and the respondent Corporation was in the process of awarding contracts. This Court directed that, in the meantime if the licence was awarded to a third party, awarding of such licence to such third party would abide by the decision to be taken by the competent authority in pursuance of the orders of this Court.

2. Learned Standing Counsel representing the respondent Corporation Sri B. Narasimha Sarma, submits that the explanation of the petitioner was received on 11.04.2014 and, therefore, the respondent Corporation has time upto 25.04.2014 to pass orders. Learned Standing Counsel further represents that notification was

issued on 04.04.2014 and last date for submission is 28.04.2014. On 04.04.2014, the tender notice was posted on the website.

3. Thus, the interest of the petitioner was sufficiently safeguarded. The time granted by this Court has not expired.

4. Until the orders are passed as directed in W.P.No.10146 of 2014, no cause survives for the petitioner to institute fresh writ petition. The writ petition is premature. Hence, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
