ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader for Home appearing for the respondents.
The grievance of the petitioner is that on 28.11.2013 when he intended to take survey of his land admeasuring Ac.4-34 guntas in Sy.No. 96 situated at Mangalapalli village, Ibrahimpatnam Mandal, Ranga Reddy district, some third parties obstructed the petitioner from conducting the survey and with regard to the same, the petitioner lodged a complaint with respondent No.4 on the same day, but no action was taken on the said complaint. Hence the present writ petition is filed seeking a direction to the respondent No.4 to take necessary action.
Respondent No.4-Inspector of Police, Ibrahimpatnam Police Station, Cyberabad has filed a counter-affidavit denying the averments made by the petitioner and stated that as there was a dispute between the petitioner and third parties, which is civil in nature, the petitioner was advised to approach competent court of law and as such no case was registered. Further in paragraph-5 of the counter-affidavit, the respondent No.4 states as follows,
“It is pertinent to submit that although the petitioner made allegations against the persons who are interfering with his subject land in question, for the reasons best known to him, not made them as proper party respondents to this writ petition. Had the petitioner made them as party respondents, then the real facts would have come to light. However, this respondent is ready and willing to provide police protection as and when the petitioner approaches this respondent police station.”
In view of the above statement of respondent No.4 in the counter-affidavit, the cause in this writ petition does not survive for consideration and the writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No costs.
