The avowed object of the Act is that an employee, who acquires disability during his service, is sought to be protected under Section 47 of the Act specifically. Such employee, acquiring disability, if not protected, would not only suffer himself, but possibly all those who depend on him would also suffer. The Apex Court in its judgments referred supra held that when an employee was afflicted with an unfortunate disease due to which he was unable to perform the duties of the post he was holding, the employer must make every endeavor to adjust him in a post in which he could discharge his duties. The Supreme Court therefore observed that such an employee would be entitled to protection of his last drawn pay. Thus, it follows that Section 47(2) of the Act asserts that a disabled employee should not even be denied promotion merely on the ground of his disability. The petitioner would therefore be entitled to count his seniority in the service of the APSRTC from the initial date of his regular appointment as a Driver in its service, notwithstanding the fact that he was thereafter shifted to the post of a Record Tracer.
