JUDGMENT :: ( per Hon’ble Sri Justice Challa Kodanda Ram )
This reference is at the instance of the assessee raising as many as four questions said to be arising from the order of the Tribunal in ITA Nos.1 & 2/HYD/1995 for the assessment years 1992-93 & 1993-94 are referred for the opinion of this Court.
2. When the matter is taken up for hearing Sri Y. Vivekananda, learned counsel representing Sri YN Lohitha, would place on record the communication received by him stating that the assessee is not interested in further pursuing the matter before the Court as the assessment pertains to the period 1992-93 & 1993-94.
3. Recording the said submission made by the learned counsel, we decline to answer the questions for non prosecution. Accordingly, the reference case is closed. Miscellaneous petitions, if any, pending in this reference case shall also stand closed. There shall be no order as to costs.
