In our view, necessary party has not been impleaded in this matter under the provisions of Order I Rule 1 Code of Civil Procedure. In the absence of necessary party, the matter has to be dismissed and it is accordingly dismissed with liberty to file a fresh one in accordance with law.
Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs.
