This appeal, under Section 54 of the Land Acquisition Act, 1894, is filed by the Special Deputy Collector (Land Acquisition) aggrieved by the order and decree, dated 26.06.1997, passed in L.A.O.P.No.1006 of 1987 by the learned Subordinate Judge, Rajampet.
An extent of land admeasuring Ac.1-00 covered by Survey No.95/1 situated at Kothapadu Village, Vontimitta Mandal, Kadapa District, belonging to the respondent – claimant along with the lands of others was acquired under the provisions of the Land Acquisition Act, 1894, as the same was coming under submergence of Somasila Project. The Land Acquisition Officer, after conducting necessary enquiry, has passed an Award fixing the compensation at Rs.11,000/- per acre for the land in question. Aggrieved by the same, the respondent – claimant sought reference under Section 18 of the Land Acquisition Act, which was tried in L.A.O.P.No.1006 of 1987 by the learned Subordinate Judge, Rajampet. The reference Court, having considered the oral and documentary evidence on record, by the impugned order, dated 26.06.1997, disposed of the said O.P. along with batch of O.Ps., by enhancing the compensation to Rs.20,000/- per acre for the land in question.
Having heard the learned counsel for appellant, we have perused the material available on record.
Having regard to the evidence on record, we are of the view that the compensation fixed by the reference Court at Rs.20,000/- per acre for the land in question is just and reasonable. Further, it is also brought to the notice of this Court that similar matters were already dismissed by this Court. Hence, we do not find any merit in this appeal, so as to interfere with the impugned order passed by the reference Court.
Accordingly, the appeal is dismissed. Miscellaneous Petitions, if any, pending shall stand closed. No costs.
