who appeared before the Joint Collector but did not file any written statement to the show cause notice. The Joint Collector, Nizamabad after thorough enquiry found that the appellant has indulged in diversion of PDS Commodities and has contravened Clause 17(b)(c),19, Annexure –I of the APS PDS (Control) Order 2008 and condition 4(i)(ii),8,10 and 12 of the authorization and ordered for confiscation of 60% value of the seized stock in favour of the Government. Aggrieved by the said order, the revision petitioner preferred appeal vide Crl.A.No.118 of 2013 on the file of the District and Sessions Judge, Nizamabad, who after hearing both sides dismissed the appeal by confirming the order of the Joint Collector and the said judgment of the learned Sessions Judge, is impugned herein with the contentions that the judgment of the learned Sessions is contrary to law, weight of evidence and probabilities of the case, that the Court not examined or observed the delivered receipts which are filed by the 2nd respondent herein, the Joint Collector also did not give any opportunity to the revision petitioner to examine the 2nd respondent or receipts, but simply passed the orders to confiscate the stocks, that the Joint Collector failed to observe that in a overnight i.e. within the 15 hours where the stock of 350 litres kerosene was gone in small village and the respondent also failed to collect the material evidence, that the Joint Collector failed to observe the version of the revision petitioner as he was in charge of the alleged fair price shop that fair price shop stock was first time taken by the petitioner and due to power cut he was unable to lift the total stock of kerosene, the kerosene wholesale dealer assured that he would come with kerosene stock in next day and deliver the remaining stock and on that cause only the appellant taken kerosene stock could not enter in the stock register of the in charge fair price shop, that Court below failed to observe that the respondent herein was clubbed the revision petitioner’s fair price shop, and in charge fair price shop kerosene and made allegation that in total 357 kerosene is less even though the petitioner
