HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.1701 of 2014

ORDER :

1) This revision is filed by the petitioner/Complainant under Section 397 and 401 Cr.P.C. aggrieved by the order dated 07.08.2014 in C.C. No.641 of 2014 on the file of the learned XII Special Magistrate, Erramanzil, Hyderabad under which the 1^st respondent herein presented a petition seeking to summon the original account opening application in an existing account at Karur Vysya Bank, Hyderabad for the purpose of comparing the admitted signature of the 1^st respondent and the same was allowed.

2) Heard the learned counsel for the petitioner.

3) The contention of the learned counsel for the petitioner is that the signatures which summoned by the trial Court viz., signatures from the Karur Vysya Bank Limited which was opened the account on 07.05.2014 for the purpose of this case to escape from liability and prejudice would be caused to the petitioner if the report is received with this signatures which were signed before the Bank in the year 2014.

4) The revision petition is disposed of at the admission stage giving liberty to the petitioner to file a similar application, as of the accused contemporary relevancy signatures stated to be with State Bank of Bikaner & Jaipur of Rashtrapathi Road, Secunderabad, before the lower Court to secure the same and send to the expert.

5) Accordingly, the revision petition is disposed of. Consequently the miscellaneous petitions pending, if any, shall stand closed.
