ORDER:
This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed by the petitioner/accused seeking to quash the proceedings in C.C.No.679 of 2013 on the file of the XVII Additional Chief Metropolitan Magistrate, Hyderabad.
2. On a lunch motion, when the matter is taken up for hearing, the learned counsel for the petitioner/accused and the 2nd respondent/complainant had submitted that the parties had entered into a compromise and settled the matter out of Court and that the terms of compromise are reduced into writing in the form of a memorandum of compromise and that the Crl.M.P.No.16269 of 2014 is filed seeking permission to compromise the matter and to quash the proceedings.
3. The petitioner/Accused and the 2nd respondent/complainant are present before this Court. They had submitted that they have entered into a compromise and asserted the terms of the compromise.
4. In view of the settlement arrived at between the parties no purpose would be served in keeping the proceedings pending. In view of the enabling provisions in the Code, permission is hereby accorded and the compromise is recorded.
5. Accordingly, Crl.M.P.Nos.16269 of 2014 is ordered and Criminal Petition No.15238 of 2014 is allowed and the proceedings in C.C.No.679 of 2013 on the file of the XVII Additional Chief Metropolitan Magistrate, Hyderabad, are quashed. The Joint Memorandum of compromise shall form part of this order. Miscellaneous petitions, if any, pending in this petition shall stand closed.
