This Criminal Petition is filed under Section 438 Cr.P.C by petitioner/A-1 in Crime No.123 of 2014 of Kandukur Town Police Station, Prakasam District, registered against him and others for the offences punishable under Sections 498-A, 506 r/w 34 IPC and Sections 3 and 4 of the Dowry Prohibition Act.

2. Heard the Learned Counsel for the Petitioner, the Learned Additional Public Prosecutor for the Respondent-State and perused the material placed on record.

3. A-1 is the husband of de facto-complainant. The allegations in the complaint disclose that all the accused harassed the complainant mentally and physically for additional dowry.

Having regard to the circumstances stated in the petition as well as submissions made by the learned counsel, instead of dismissing from not entitled to the pre-arrest bail, but for regular bail in considering his personal liberty, this application is disposed of, by giving liberty to the petitioner-accused No.1 to surrender before the Learned Magistrate concerned to take into custody under Section 44 Cr.P.C by virtue of this order, move before the learned Magistrate for regular bail and with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Judge/Magistrate shall consider for granting of bail in favour of the petitioner with necessary conditions preferably on the same day if not atleast by the next day. 5. The petitioner is directed to attend for counseling when his presence is required. Needless to say, if any permission to leave the country is required it must be with prior permission of the Court to

relax the condition and to return of passport to be deposited for any particular period or the like and pursuant to the mandate of Section 6(2)(f) of the Passport Act read with G.S.T.1993.
