This Criminal Petition is filed under Section 438 Cr.P.C by petitioners/A-3 and A-5 seeking anticipatory bail in Cr.No.805 of 2013 of police Station Penamaluru, Vijayawada City, Krishna District registered against them for the offences punishable under Sections 306 r/w.34 IPC. 2. Heard the Learned Counsel for the Petitioners and the Learned Additional Public Prosecutor for the Respondent-State and perused the material placed on record.

3. A perusal of record reveals that petitioners are A-3 and A-5 and they are Mathematics Lecturer and warden of Sri Chaitanya Girls college, Poranki, Vijayawada respectively. A-1 and A-2 are the Principal and Vice-principal of the said college respectively. The allegation from the report given by the father of de facto complainant is that the college management is pressurizing and from the psychiatric pressure the deceased committed suicide and in particular his allegation his daughter was even earlier complaining about the Mathematics Lecturer and warden was pressurizing in the academics and even he asked them not to give pressure in her academics, but it was not heeded.

The contention of the petitioners is that at the cost of reputation as was about lower Court in para 3 of the dismissal bail application in Crl.M.P.No.1483 of 2014 by these petitioners while granting bail to A-1 and A- 2 is that one of the sisters of deceased also completed academics in the college and got some professional course admission and there is psychiatrist of full employment to give counselling to any required students for their academics and they are not responsible. 5. Taking consideration of the propensity of the crime, the petitioners are not entitled to the concession of anticipatory bail, but for in considering the personal liberty for regular bail. It is needless to say in granting regular bail one of the conditions to be imposed by the learned Magistrate concerned are that if in future they repeat such crime, the bail shall stand be cancelled. It is subject to the above, instead of dismissing the application, this application is disposed of, by giving liberty to the petitioner-accused to surrender before the

Learned Magistrate concerned to take into custody under Section 44 Cr.P.C by virtue of this order, move before the learned Magistrate for regular bail within 15 days from the date of receipt of this order and with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Magistrate shall consider by granting bail in favour of the petitioner/Accused preferably on same day if not atleast by next day with necessary conditions.
