At the interlocutory stage, the matter is taken up for hearing and disposal with the consent of the learned counsel for both the parties.

This civil miscellaneous appeal arises out of order, dated 14.03.2014, in I.A.No.99 of 2013 A.S.No.376 of 2013, on the file of the learned XXIV Additional Chief Judge, City Civil Court, Hyderabad.

I have heard Sri T.Sharath, learned counsel for the appellants, and Sri C.B.Ram Mohan Reddy, learned counsel for the respondents.

Having regard to the fact that the appeal, which is A.S.No.376 of 2013, is pending before the lower appellate Court, any finding rendered by this Court in this appeal may affect the outcome of the said appeal, both the learned counsel have fairly agreed that the appeal itself may be directed to be disposed of at an early date and that both the parties may be directed to maintain status quo prevailing as on today with regard to the physical possession of the suit schedule properties.

Having regard to this fair submission of the learned counsel for both the parties, the CMA is disposed of without adjudicating the same on

merits with a direction to the lower appellate Court to dispose of A.S.No.376 of 2013 on merits within four months from the date of receipt of a copy of this order. Till disposal of the appeal, both the parties shall maintain status quo as on today with regard to the physical possession of the suit schedule properties.

As a sequel to disposal of the CMA, C.M.A.M.P.No.750 of 2014 shall stand disposed of as infructuous.
