THE HON’BLE SRI JUSTICE L. NARASIMHA REDDY CONTEMPT CASE No.625 of 2014

ORDER:

This Contempt Case is filed alleging that the respondents did not implement the orders passed by this Court on 01.02.2011 in W.P.M.P.No.36476 of 2010 in W.P.No.28597 of 2010. Through the said order, this Court directed the respondents to implement Clause VII of G.O.Ms.No.6, dated 18.08.2009, in relation to payment of wages to the semiskilled and unskilled categories of workers.

The petitioner contends that though the direction is specific, the respondents are now paying wages under G.O.Rt.No.333 dated 07.03.2011.

The respondents filed counter-affidavit opposing the Contempt Case. According to them, a policy decision has been taken by the Government in relation to payment of wages to the Contract labourers engaged by the local bodies and the wages payable thereunder are in excess than what was paying to the petitioner herein.

Heard the learned counsel for the petitioner and the learned counsel for the respondents.

G.O.Ms.No.6 is general in its purport. At a time when no specific arrangement was made by the Government in respect of Municipalities and the Municipal Corporations, payment of wages used to be governed by that G.O. The respondents implemented G.O.Ms.No.6. In the meanwhile, the Government issued G.O.Rt.No.333, Municipal Administration and Urban Development (G2) Department, dated 07.03.2011. That provides for payment of wages at Rs.6,700/- per month for the employees engaged on contract basis or outsourcing. It is brought to the notice of this Court that the said amount has been enhanced to Rs.9,000/- per month. Hence, it

cannot be said that the respondents have deliberately violated the order of this Court.

The Contempt Case is accordingly closed. There shall be no

order as to costs.
