JUDGMENT: (Per Hon’ble Ms. Justice G.Rohini)
This appeal is preferred aggrieved by the defendant against the judgment and decree dated 05.07.2004 in O.S. No.72/2002 on the file of the Court of the Senior Civil Judge, Sangareddy. The defendant is the appellant before us.
By the judgment and decree under appeal the Court below granted a preliminary decree with costs in favour of the respondent herein for Rs.7,35,406/- together with subsequent interest @ 17.5% per annum from the date of suit till the date of realization, and three months time was granted for redemption.
When the matter is taken up for consideration it is brought
to our notice by the learned counsel for the appellant/defendant that during the pendency of this appeal there was a settlement between the parties outside the Court in December 2013 and the entire amount due to the respondent/plaintiff has been paid. The said fact has not been disputed by the learned counsel appearing for the respondent/plaintiff/Life Insurance Corporation of India. Under the circumstances, no further enquiry is necessary in this appeal.
Accordingly recording the fact that the matter has been settled between the parties and the entire amount due to the respondent/plaintiff has been paid, the Appeal Suit is disposed of. No costs.
Consequently, miscellaneous petitions, if any, pending in the Appeal Suit, shall stand closed.
