This Writ Petition is filed for the following substantive relief:

“………to issue a writ, order or direction more particularly a Writ of Mandamus declaring award vide proceedings No.LA/Unit-I/152-1/2006, dated 17.03.2009, of respondent No.3 as arbitrary, discriminatory, illegal and void insofar as the said award relates to the land of the petitioner in Sy.No.322/1 of Mankal Village, Gram Panchayat of Tukkuguda Village, Maheshwaram Mandal, Ranga Reddy District and consequently, direct the respondents to pass fresh award after giving notice to the petitioner.”

At the hearing, it is agreed among the learned counsel for the parties that the issues raised in this Writ Petition are identical to that adjudicated by this Court vide

order, dated 10-02-2010, in Writ Petition No.2247 of 2010.

Following the same, this Writ Petition is disposed of in terms of the aforesaid Order by setting aside the award, vide proceedings No.LA/Unit-I/152-1/2006, dated 17.03.2009, of respondent No.3 in respect of the petitioner’s land admeasuring Acs.2-10 guntas in Survey No.322/1 of Mankal Village, Gram Panchayat of Tukkuguda Village, Maheshwaram Mandal, Ranga Reddy District, only to the extent of referring the dispute to civil Court under Sections 30 and 31 of the Land Acquisition Act, 1894 (for short ‘the Act’). The petitioner is permitted to make a claim before respondent No.3 within two weeks from today. Within two months thereafter and before taking further steps under Sections-30 and 31 of the Act, respondent No.3 shall determine the claim of the petitioner.

As a sequel to disposal of the Writ Petition, W.P.M.P.No.6960 of 2013 filed by the petitioner for interim relief is disposed of as infructuous.
