ORDER:

Land to an extent of Ac.0.10 guntas equivalent to 1210 Sq yards situated in Pedda Nagaram village, Narsimhulupeta mandal, Warangal district was acquired in the year 2009 for excavation of the canal 1L-18RDBM-60. Pursuant to the land acquisition proceedings, compensation was determined and paid to the other land owners whose land was also acquired but insofar as petitioner is concerned, compensation is not paid till date. Learned counsel for petitioner submits that having acquired the land, it is wholly illegal on the part of the respondents in not paying the compensation. He submits that the action of the respondents is also arbitrary and discriminatory as compensation to the petitioner is not paid without any justification, whereas in pick and chose method compensation was paid to other land owners whose land was also acquired.

On instructions, learned Government Pleader for Irrigation submits that the amount released by the Government was not sufficient to pay compensation to all the land losers and as such compensation could not be paid to all the land losers. He further submits that due to financial constraints the balance amount could not be released and requested to grant some more time for release of balance amount.

Recording the said submission of the learned Government Pleader for Irrigation, writ petition is disposed of directing the respondents 3 and 4 to take steps to deposit the amount of compensation payable to petitioner with the Special Deputy Collector/5^th respondent within a period of eight weeks from the date of receipt of copy of this order. On such deposit, 5^th respondent shall take steps to release the amount to the petitioner within a further period of two weeks. No costs.

Sequel to the disposal of the writ petition, miscellaneous petitions, if any stand dismissed.
