ORDER (Per the Hon’ble Sri Justice N.Ravi Shankar):

Heard the petitioner’s Counsel and also the learned Government Pleader for the respondents.

The point raised in this Writ Petition is whether the petitioner is eligible for selection to a Secondary Grade Teacher (Kannada medium) post in the Mahabubnagar District to the D.S.C. 2008. Having lost on the said point before the Tribunal, the petitioner is before us.

The petitioner’s case is that she belongs to BC-E category and women vacancies available in the other BC categories can atleast be transferred to her category and she can be appointed. This is not possible. Even if such conversion is permissible, those vacancies will have to go to OC category as urged by the learned Government Pleader.

Rejecting the case of the petitioner for O.C post and her claim, the Tribunal has observed in para 17 of its order as follows:

“The applicant is Women candidate belonging to BC-E category. She could not qualify for consideration, though she is eligible for selection in OC-General and OC-Women community as in the category of OC (General), the last candidate has secured 30.00 marks with 11^th rank and in the category of OC (women), the last candidate secured 38.50 marks with 13^th rank whereas, the applicant has secured only 23.50 marks with 144^th rank. Hence, she could not up for selection under OC Women and OC General category, as she got less marks. Further, as per the list prepared with particulars of 70:30 reservation and as per G.O.Ms.No.61 and 62 dated 29.10.2010 relating to Mahabubnagar District of DSC 2008, no posts were reserved for BC-E Women category.

The above reasoning of the Tribunal does not suffer from any infirmity or legality. Hence, we do not find any reasons to interfere with the impugned order.

Accordingly, the Writ Petition is dismissed at the admission stage. Miscellaneous Petitions, if any, pending in this writ petition shall stand closed.
