ORDER:
The short and simple grievance of the petitioners in this writ petition is that their applications made for grant of Occupancy Rights Certificate (for short ‘ORC’) in respect of the lands admeasuring Ac.665.23 gts. in Sy.Nos.33 to 38 etc., of Sikindlapur Village, Shivampet Mandal, Medak District, are not being disposed of by respondent No.2.
Respondent No.3 filed a counter affidavit, wherein he has raised several averments reference to which are not necessary, as this Court is not proposing to adjudicate on the rights of the parties on merits.
As the grievance of the petitioners, as noted above, is confined only to non-disposal of ORC applications by respondent No.2, he is directed to hold an enquiry and pass appropriate order thereon. If respondent No.2 finds any legal constraints in disposing of the applications on merits or granting ORC, he shall, after enquiry, pass a speaking order and communicate the same to the petitioners. He shall complete this process within a period of three months from the date of receipt of this order.
Subject to the above directions, the Writ Petition is disposed of.
As a sequel, W.P.M.P.Nos.40346, 40347 & 40348 of 2012 filed by the petitioners for interim relief are disposed of as infructuous.
