It is brought to our notice that aggrieved by the proceedings initiated by the respondent Bank under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, ‘the SARFAESI Act’), the petitioner has already filed Securitisation Appeal under Section 17 of the SARFAESI Act before the Debts Recovery Tribunal, Hyderabad.

Therefore, leaving it open to the petitioner to pursue the appeal pending before the Tribunal, the Writ Petition is dismissed. No costs. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
