The petitioner joined the service of Census Department of Government of India in the year 1968 as Assistant Compiler. Over the period, he earned various promotions and on 10.10.1991, he was promoted to the post of Assistant Director, on ad hoc basis, duly allowing the scale of pay meant for that post. Thereafter, he was promoted, on regular basis, in the year 1997. Claiming that his promotion effected on 10.10.1991 is on regular basis and he must be deemed to have been promoted on regular basis with effect from that date, the petitioner filed O.A.No.68 of 1999 before Hyderabad Bench of Central Administrative Tribunal. The respondents, however, pleaded that the promotion of the petitioner in the year 1991 was purely on ad hoc basis to meet the exigencies of work and that he has become eligible to be considered, on regular basis, only in the year 1997. It was also mentioned that the promotion can be effected only on being cleared by Departmental Promotion Committee (D.P.C.) and that the case of the petitioner was not considered by the D.P.C. in the year 1991. The Tribunal dismissed the O.A. through order, dated 23.10.2000. Hence, this writ petition.
