This writ petition is filed by six individuals, who claimto be owners of the property bearing No.11-13-113/2, Vasavi Colony, Saroornagar, Ranga Reddy District, challenging the demand notice dated 26.8.2001 issued by the L.B. Nagar Municipality, Ranga Reddy District.
The L.B. Nagar Municipality has not been impleaded as a party. Only the Municipal Commissioner, L.B. Nagar Municipality, Ranga Reddy District is impleaded as the sole respondent. Since the L.B. Nagar Municipality is a body corporate authorised to sue and liable to be sued in its corporate persona, under provisions of the Andhra Pradesh Municipalities Act, 1965, the Writ Petition must fail as the proper and necessary party – L.B. Nagar Municipality has not been impleaded as a respondent.
For the aforesaid reasons, the writ petition is dismissed as not maintainable. No order as to costs.
