When the matter came up for hearing, learned counsel for the 1^st respondent-bank submits that the sale was conducted and the sale certificate was also issued by the bank in respect of the subject property. It is also stated by the learned counsel that after appropriating the loan amount from out of the sale proceeds, the balance amount was deposited into the account of the petitioner and the petitioner also withdrew the amounts from his account. This submission made by the learned counsel for the 1^st respondent-bank is not disputed by the learned counsel for the petitioner. However, learned counsel for petitioner submits that the title documents in respect of land to an extent of Ac.5-00 situated in Sy.No.115, Chinthakunta Village, are still with the 1^st respondent-bank.

2. In view of the fact that the entire loan is already appropriated from out of the sale proceeds, the 1^st respondent-

bank is directed to return the said title documents in respect of land to an extent of Ac.5-00 situated in Sy.No.115, Chinthakunta Village, to the title holder if 1^st respondent has no other lien over the borrower and the property concerned. It appears one cheque book is also with the bank and the same also be returned to the petitioner.

3. With the above directions, the writ petition is disposed of. Miscellaneous petitions, if any pending in this case shall also stand dismissed. There shall be no order as to costs.
