It is represented by the learned counsel for both parties that the issue involved in this Writ Petition is squarely covered by the decision of the larger Bench of this Court in L. Royal Reddy and
Others Vs. Government of Andhra Pradesh and Others[1] .
Recording the submission of the learned counsel and following the said decision of the larger Bench, the impugned demand is hereby set aside.
Accordingly, the Writ Petition is disposed of with a direction to the respondents to take necessary steps afresh. No costs.
In case any amount is deposited by the petitioner, the same shall be given credit to while assessing the liability of the petitioner.
Consequently, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
