The issue raised in this writ petition is with regard to the refusal by the Registration authorities to register documents presented by the petitioners in respect of plots situated in Sy.No.164/3 of Vepagunta Village, Pendurthy Mandal, Visakhapatnam.

2. This Court had occasion to deal with the very same issue in the context of other plots in Sy.No.164/3 of Vepagunta Village, Pendurthy Mandal in W.P.Nos. 2119 of 2013 and 2121 of 2013. Individual orders dated 30.01.2013 passed in the said writ petitions are placed on record.

For reasons alike as were mentioned in the said orders, this writ petition is disposed of directing the Sub-Registrar, Gopalapatnam, Visakhapatnam, to receive and process the documents presented by the petitioners in respect of their plots in Sy.No.164/3 of Vepagunta Village, Pendurthi Mandal, without reference to the fact that the Government is treating this land as its own. In the event, the documents presented by the petitioners are found to fulfill the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the Sub-Registrar, Gopalapatnam, shall complete the registration formalities and release the documents in accordance with the due procedure. This order shall however not preclude the Government from asserting and establishing its title in respect of the subject land in accordance with law before the competent forum and seeking cancellation of the documents. W.P.M.P. No.16164 of 2013 shall stand closed in the light of this final order. No costs.
