When the matter came up on 23.01.2013, the learned Government Pleader for Home sought time to obtain instructions. Today, the learned Government Pleader, on instructions, states that a complaint was given by the Tahsildar, Badvel Mandal on 18.10.2012 that two persons had produced some house site pattas relating to Survey No.1772 situated at Chennamapally village of Badvel Mandal with regard to house site No.195 claiming that they are the owners of the said site, and were given possession certificates; thereupon a complaint, in Crime No.199 of 2012 for offences under Sections 468 and 420 IPC, was registered and the matter was taken up for investigation; and on examination of the complainant-Tahasildar, it came to light that those persons had purchased the subject property from the petitioner. The second respondent would state that the matter is still under investigation; till date the petitioner’s name is not shown in the First Information Report; however, basing on the investigation and if the petitioner’s involvement in the offence comes to light, the respondents would take necessary action against her, duly following the procedure contemplated under the Code of Criminal Procedure. Learned Government Pleader would further submit that the second respondent did not summon the petitioner to the police station and, with a view to escape from the criminal liability, the petitioner has rushed to this Court to pre-empt the authorities from taking action in accordance with law.
