M/s.Deshmukh Cotton Industries, Adilabad, is the petitioner in these two writ petitions. Its grievance is with regard to the electricity bills generated by the Northern Power Distribution Company of Andhra Pradesh Limited (APNPDCL) towards its power consumption.

It is now stated by Sri G.Pramod Kumar, learned counsel for the petitioner, that the APNPDCL has issued revised bills for the

consumption months of November and December, 2012, January, February, March and April, 2013. Deducting the amount of Rs.15,00,000/- already paid by it, the petitioner was called upon to remit the balance of Rs.7,82,421/-. This amount was directed to be paid within 15 days under letter dated 29.06.2013 of the APNPDCL. Sri G.Pramod Kumar, learned counsel, states that as this is not the season for the petitioner’s industry, which is dependant upon cotton, it would be hard pressed to make the payment in lumpsum as directed by the APNPDCL.

As the petitioner proposes to clear its dues to the APNPDCL and it is only due to financial constraints that the same is being delayed, the writ petition is disposed of permitting the petitioner to make the payment of the balance amount due in four equated monthly instalments, each such monthly instalment being due and payable by the end of the calendar month. The first such instalment shall be paid on or before 30.09.2013. The APNPDCL shall not take any coercive measures against the petitioner as long as it abides by the above time stipulations. In the event the petitioner fails to make the payment of any instalment as per the above time schedule, it shall be open to the APNPDCL to take necessary steps against the petitioner in accordance with law. Pending miscellaneous petitions in these two writ petitions shall stand closed in the light of this final common order. No order as to costs.
