THE HON’BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION NO.10136 OF 2013
ORDER:
This writ petition is preferred by a Field Assistant who has been placed under suspension on 21.09.2012 complaining that the said order has been passed without any serious application of mind to the relevant facts and circumstances of the case. It is also now pointed out that, in somewhat similar circumstances, another enquiry which was conducted on other employees, similar allegations have been leveled and that enquiry was conducted and by imposing a fine of Rs.1,000/and by administering a warning to be careful in future and they were all reinstated and in the case of the petitioner, instead of conducting the enquiry, final orders are not passed. As a result, this writ petition is filed.
Sri M. Subrahmanyam, who took notice on behalf of the respondent and Sri G. Elisha who took notice on behalf of the second respondent, would submit that, in a fortnight time from today, the entire matter will be decided by the Project Director, District Water Management Agency, Kakinada and appropriate final orders would be passed.
In view of the statement made at the Bar, I do not consider that it is necessary to admit this writ petition and keep it pending. It would be sufficient if I direct the Project Director to pass final orders and communicate the same within a period of fifteen days from today.
Writ petition stands disposed of. Miscellaneous applications if any, shall stand disposed of. No costs.
