JUDGMENT: (per the Hon’ble Sri Justice N.V.Ramana)

This appeal is directed against the interim order passed by the learned single Judge.

The Order itself states that by then, respondent Nos.1 to 5 had not filed any counter-affidavits and on the basis of the report submitted by the District Collector in pursuance of the Orders of the Court dated 21.01.2013, learned single Judge gave certain directions.

We have heard the learned Senior Counsel for appellants and the learned counsel appearing for the contesting respondents as well as learned Government Pleader.

We are not inclined to interfere with the impugned order primarily for the reason that it is an interim Order. All the learned counsel state that the pleadings are now ready and the writ petition itself can be taken up and disposed of at an early date.

We, therefore, dispose of the writ appeal and direct the Registry to list the writ petition for final hearing before the appropriate Court as per roster. We also request the learned single Judge to take up and decide the writ petition at an early date. Liberty is also granted to the both parties to make a request before the learned single Judge for early disposal

of the writ petition. Accordingly, the writ appeal is disposed of. Miscellaneous petitions, if any, filed in the writ appeal shall stand

closed. There shall be no order as to costs.
