As has already been seen above, the tender notice pursuant to which three agencies were empanelled stated the purpose of the tender being ‘to organize film shows, Kalajatha programmes like street plays, puppet shows, mimicry etc. on various schemes of the Government, as and when required, through I & PR Department and the tender itself envisages that the number of programmes may be increased or decreased by the I & PR Department, but the agency has to execute the work as per the approved rates’. The third respondent was informed by the Director, I & PR Department, under letter No.11752/ADVT.11/2011 dated 22.09.2011, the list of empanelled agencies together with rates fixed by the Government. The third respondent, thereafter, under his letter dated 28.05.2012 informed the Commissioner, I & PR Department, about intention to take up publicity work through mobile vans in rural areas to create awareness in water supply and sanitation programmes. The aforesaid correspondence clearly establishes that even the third respondent was aware of empanelment of agencies but, however, chose to issue impugned tender notice separately on the ground that I & PR Department had informed the third respondent that it has no staff at grass root level to supervise the work. In our view, the very purpose of empanelment would stand defeated if each department of the State Government was to take up the work of publicity relating to various schemes of the Government by issuing different tenders and considering different agency to work therefor.
