ORDER:
This Transfer Civil Miscellaneous Petition is filed seeking transfer of I.P.No.21 of 2009 from the file of the learned VII Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar to the file of the learned Senior Civil Judge, Tadepalligudem.
Respondent No.1—U.M.V.Nageshwara Rao filed the aforesaid
I.P. giving the following address:
“U.M.V.Nageshwara Rao, S/o.Surya Narayana, aged about 30 years, occu:Business, R/o. LIG 171/8, 4th Phase,K.P.H.B.Colony, Hyderabad72.”
Notice in this transfer application has been taken to the same address and the said notice is returned with an endorsement “no such person in this address”. Since the notice has been sent to same address mentioned in the I.P. filed by respondent No.1, it is deemed that notice is served on him. It is submitted that the other respondents are not necessary parties and they are sailing with the petitioner.
The petitioner’s case is that the sister of respondent No.1 filed O.S.No.151 of 2009 on the file of the learned Senior Civil Judge, Tadepalligudem, seeking declaration of title and that respondent No.1 in his petition in I.P. No.21 of 2009 averred that he has business in the rural areas of Tadepalligudem.
In the above circumstances, I.P.No.21 of 2009 pending on the file of the learned VII Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar, is withdrawn and transferred to the Court of the learned Senior Civil Judge, Tadepalligudem.
The Transfer Civil Miscellaneous Petition is allowed accordingly. No costs.
Miscellaneous petitions, if any pending in this petition, shall stand closed.
