HON’BLE SRI JUSTICE B. CHANDRA KUMAR SECOND APPEAL No.682 of 2000
J U D G M E N T
It was represented on 08.10.2012 that the sole respondent died. Since then, time has been granted to the appellant, to take steps to bring the legal representatives of the sole respondent on record. But, the appellant failed to take such steps. On 4.11.2013, the appeal is ordered to be posted under the caption ‘for dismissal’ for not taking steps. Accordingly, the mater is posted under the caption ‘for dismissal’ today.
Today also, though the matter is posted under the caption ‘for dismissal’, no steps are taken till this date. Therefore, I am not inclined to grant any further time since already sufficient time has been granted to the appellant.
Accordingly, the Second Appeal is dismissed for not taking steps for not bringing the legal representatives of the sole respondent on record. No order as to costs. Miscellaneous petitions, pending if any in this Second Appeal shall stand closed.
