A notification, dated 16.05.1989, under Section 4 (1) of the Land Acquisition, 1894 (for short ‘the Act’) was published by the District Collector, Ranga Reddy, proposing to acquire Acs.36.15 cents of land in Roshandowla, Kothapet, Balapur, Chintalkunta, Meerpet, Jillalguda and Kharmanghat Villages for the purpose of providing a bypass road for Defence Research and Development Institution. The land of respondents 1 and 2 was also included. An award was passed on 05.12.1989 determining the market value at Rs.15/- per square yard. Not satisfied with that, the respondents and other similarly situated persons sought for reference. On a reference being made, the Court of the I Additional Senior Civil Judge, Ranga Reddy District took up the matter as O.P.No.115 of 1990 and batch (O.P.No.118 of 1990 in respect of the respondents). Through a common order, dated 21.04.1998, the trial Court enhanced the market value to Rs.20/- per square yard. Challenging the same, the appellant filed A.S.No.1309 of 2001 vis-à-vis the decree in O.P.No.118 of 1990. Similar appeals were filed against the decrees in other cases also. Through a common judgment, dated 12.04.2001, a learned Single Judge of this Court dismissed the appeals. However, while dismissing the appeals, the learned Judge issued a direction to the District Collector, Ranga Reddy requiring him to issue notices to the owners of the land covered by the same notification, but who did not seek reference under Section 18 of the Act. This appeal is filed feeling aggrieved by the said direction.
