CIVIL REVISION PETITION No.6147 OF 2010

ORDER:

The 1^st respondent filed O.S. No.1273 of 2008 in the Court of II Additional Junior Civil Judge, Vishakapatnam, against respondents 2 to 5 and the petitioner for recovery of certain amount on the strength of a chit transaction. It appears that the suit has been decreed and the decree became final. The 1^st respondent filed E.P. No.214 of 2010 and on the basis of the orders passed therein, deductions were effected from the salary of the petitioner. Petitioner contends that he was only a guarantor and there was no justification for effecting the deductions from his salary.

2. Heard Sri V. Rajagopal Reddy, learned counsel for the petitioner. Though the 1^st respondent was put on notice to the interim order, he did not enter his appearance.

3. The petitioner did not file any specific order before this Court, through which deductions are made.

4. Be that as it may, if the deduction is on the strength of any order, petitioner can approach the executing Court itself for modification and withdrawal of the same by pointing out the difficulties, if any. The interim order passed by this Court on 31-12-2010 is not in operation.

5. Hence, the Civil Revision Petition is disposed of leaving it open to the petitioner to approach the executing Court seeking modification of the order of deduction, if any. The order of stay passed

by this Court on 31-12-2010 shall remain in force for three (03) months from today. There shall be no order as to costs.

6. Consequently, the Miscellaneous Petition filed by the petitioner in this revision shall also stand disposed of.
