This civil revision petition has been filed by the petitioner herein challenging the Order dated 04.06.2012, passed in R.C.A.No.16 of 2011 by the Principal Senior Civil Judge, Nellore, confirming the order dated 08.08.2011, passed in R.C.C.No.33 of 2009, by the Rent Controller-cum-Principal Junior Civil Judge, Nellore.

The learned counsel for the petitioner submits that the eviction petition filed by the landlords is pending. However, the application filed by the petitioner seeking permission to deposit the rents has been dismissed. Though, he carried the matter in the appeal, the appellate Court has also confirmed the orders of the rent controller Court.

Sri T.C. Krishnan, learned counsel for the respondents, submits that both the Courts have given a categorical finding that there is no relationship of tenant and landlord between the petitioner and the respondents and in the view of above finding, the petitioner cannot be permitted to deposit the rents into the Court. Admittedly, the eviction petition is pending before the rent controller Court, no final orders have been passed and it may take sometime for final disposal of the said case. Admittedly, the petitioner has been in possession of the property. In what capacity he is in possession or how he has acquired the possession of the premises are the points to be determined by the rent controller Court.

Accordingly, without prejudice to the pleas and contentions of both the parties, the civil revision petition is disposed of directing the petitioner herein to deposit a sum of Rs.4,000/- (Rupees four thousand only) per month to the credit of R.C.C.No.33 of 2009, pending disposal of the eviction petition. The rent controller Court is directed to dispose

of the eviction petition as early as possible preferably within a period of six (06) months from the date of receipt of copy of this Order. No costs. Consequently, Miscellaneous Petitions, if any, pending in this revision

shall stand closed.
