ORDER:

The revision petitioner is the judgment-debtor No.5 in E.P.No.51 of 2012 in O.S.No.41 of 1999 on the file of the Court of the II-Senior Civil Judge, City Civil Court, Hyderabad. The respondent No.1 herein is the decree-holder who filed the E.P. for realization of the decretal amount by attachment of salary of judgment-debtor No.5/revision petitioner. Despite notice, as the judgment-debtor No.5/revision petitioner failed to appear, he was set ex parte by order dated 9.10.2012 and warrant was issued for attachment of salary. Thereafter, the revision petitioner came up with an application to set aside the ex parte order dated 9.10.2012. He also filed E.A.No.346 of 2012 for condonation of delay in filing the said application. By the order under Revision, the Court below dismissed E.A.No.346 of 2012.

Having heard the learned counsel for the petitioner and having perused the material available on record, I do not find any justifiable reason to interfere with the order under Revision.

Accordingly, the Civil Revision Petition is dismissed. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this civil revision petition shall stand closed.
