ORDER
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to modification of the order dated 6.11.2013 passed in Crl.M.P.No.4027 of 20123 by the IV Additional Metropolitan Sessions Judge, Hyderabad.
Heard learned counsel appearing for the petitioner and learned Additional Public Prosecutor representing the respondent-State.
While granting anticipatory bail to the petitionerA5 on certain conditions, the learned IV Additional Metropolitan Sessions Judge, Hyderabad, recorded a finding that at the time of offence, he was in Aeroplane coming from Jedda to Hyderabad and his presence is doubtful at the relevant point of time. The said finding was recorded based on the flight ticket and passport of the petitioner.
In view of the same, imposing onerous conditions against the petitioner, in my view, is not proper. The condition with regard to surrender of his passport and to report before the Investigating Officer on 30th of every month, is hereby set aside.
The Criminal Petition is allowed accordingly.
