certificate, statements of the family members of PW.1 had to be recorded by the first respondent, and for recording the said statements, the first respondent allegedly demanded an amount of Rs.200/- (Rupees two hundred only) from PW.1 on 09.12.1990. PW.1, who is not willing to pay the bribe amount, approached the Deputy Superintendent of Police (for short “DSP”), ACB, Rajahmundry on 11.12.1990 and gave Ex.P6-report. Basing on his report, a case in Crime No.6/RC-RZY/1990 was registered and a trap was laid on 12.12.1990. It is the version of prosecution that in the course of the said trap, for the purpose of recording the statements of PW.1 and his sister K. Satyanarayanamma (PW.2), the first respondent demanded an amount of Rs.200/-, when PW.1 offered the amount of Rs.200/-, the first respondent/A1 directed PW.1 to pay the amount to the second respondent/A2, the Village Servant, who came along with him to the house of PW.1 at the time of recording the statements of PW.1 and his sister PW.2. Subsequently, it is the prosecution story that on the pre-arranged signal given by LW.2 – Madhura Satyanarayana, who was the friend of PW.1 and acted as an accompanying witness. On the instructions of the DSP, ACB, the raiding party rushed in and questioned A1 as to whether he received the bribe amount from PW.1 and thereafter, on his denial, he questioned about the bribe amount and recovered the same from A2, when he produced the same by picking it up from his shirt pocket. Thereafter, it is said that the chemical test conducted on the fingers as well as the shirt pocket of A2 yielded positive results.
