JUDGMENT:
C.C.C.A.No.249 of 2001 has been filed by the appellant, aggrieved by the decree and judgment dated 05.10.2001 passed in O.S.No.53 of 1998 by the I Additional Chief Judge, City Civil Court, Secunderabad.
Parties have entered into compromise and to that effect they filed C.C.C.A.M.P.No.207 of 2013 under Order XXIII Rule 3 of Civil Procedure Code.
Both Parties and their counsel are present before this Court. The parties are recognized by their learned counsel and they affixed their signatures on the compromise memo. The counsel also affixed their signatures on the compromise memo.
A sum of Rs.45,00,000/- (Rupess forty five lakhs only) is paid by D.D.No.000199, in favour of the 1st respondent, drawn on HDFC Bank, Kushaiguda, Hyderabad – 500062.
In view of the above circumstances,
C.C.C.A.M.P.No.207 of 2013 is allowed and the Appeal stands disposed of in terms of the compromise entered into between the parties, and the suit filed by the 1st respondent stands dismissed. No costs.
