Earlier, on 06-02-2012, when the matter came up for hearing, none appeared for the appellant and the matter was directed to be listed today under the caption ‘for dismissal’. Even today also when the matter is taken up for hearing, none appears for the appellant.
In the circumstances, the appeal is dismissed for non-prosecution. There shall be no order as to costs.
As a sequel to the dismissal of the appeal, A.S.M.P.No.170 of 2012 is also dismissed.
