This Writ petition is filed for issuance of a writ of Habeas Corpus directing the respondents to produce petitioner’s wife Smt. Syed Liquanisa, aged 46 years, elder son Mohd. Shakeel, aged 27 years, younger son Md.Kaleel, aged 23 years and daughter Zebaunnisa, aged 22 years, R/o. House No.19-3-751, Mahammedia colony, Alinagar, Shalibanda, Hyderabad and to release them from illegal detention of the 3rd respondent.
In response to the notice issued by this court, the
3rd respondent – Station House Officer, Tappachaputra police Station,
Hyderabad filled the counter-affidavit stating that the alleged detenus 1 and 3 are accused Nos.2 and 3 in Crime No.13 of 2012 of Humayunagar Police Station, Hyderabad. In pursuance of the above crime, they were arrested by the police of Humayunagar police station on 14.01.2012 at 09.15 hours at Gulzar House, Hyderabad and they were produced before the VI Additional Metropolitan Magistrate, Nampally, Hyderabad on 15.01.2011 and the learned Magistrate remanded them to judicial custody. In so far as alleged detenus 2 and 4 are concerned, they are not wanted in any crime pending with any of the police stations in Hyderabad city and they are moving outside very freely, which fact was not denied by the learned counsel for the petitioner. In view of the same, there is no need to pass any further orders.
Accordingly, the writ petition is dismissed. There shall be no Order as to costs.
