The Government of Andhra Pradesh issued G.O.Ms.No.9, dated 06.01.2000 framing three charges. The petitioner submitted explanation, but the enquiry could not be completed as the Enquiry Officer was changed. The petitioner retired on 31.08.2003 and was granted provisional pension. The enquiry could not be completed even after five years. Therefore, the first respondent filed O.A.No.5829 of 2006 challenging the charge memo. The same was disposed of by the APAT on 14.08.2007 directing the conclusion of the disciplinary proceedings within two months. The APAT also observed that if the enquiry is not completed, the proceedings shall lapse and the employee shall be entitled to all the benefits. The Enquiry Officer submitted report on 22.09.2008 holding all charges as proved. A show cause notice was issued on 28.11.2008, which was assailed in O.A.No.1195 of 2009. In the meanwhile, the Government filed W.P.No.7363 of 2009 challenging the order of the Tribunal in O.A.No.5829 of 2006. The same was dismissed on 08.09.2010. Thereafter, by impugned order the Tribunal allowed the two O.As as referred to above directing the petitioners to treat the period of suspension from 21.06.1999 to 16.10.1999 as on duty by releasing the annual grade increments.
