The petitioner company availed credit facilities from the State Bank of Hyderabad in 1994. As there was default, the bank filed mortgage suit being O.S.No.1387 of 1994 on the file of the Court of the Fifth Additional Judge, City Civil Court, Hyderabad for a decree for an amount of Rs.3,07,779.78 ps with interest at 18% per annum. The suit was decreed on 30.10.1995. The Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (the Act) came into force on 26.1.2002. By invoking the provisions of the Act, the respondent issued notice of demand dated 06.5.2006 calling upon the petitioner to pay the amount due (Rs.5,26,221.75) within 60 (sixty) days from the date of the notice. The petitioner did not pay the amount. The respondent, therefore, issued possession notice on 10.6.2006. The petitioner sent a representation purportedly under Section 13(3A) of the Act on 09.8.2006. When there was no response, the petitioner filed W.P.No.16532 of 2006. This Court disposed of the writ petition on 11.8.2006 directing the respondent to consider the representation made by the petitioner.
