The 1^st respondent herein, who is the applicant before the Andhra Pradesh Administrative Tribunal in O.A.No.2102 of 1995 filed W.P.M.P.No.857 of 2012 seeking an independent direction to consider his case for promotion in the existing vacancy on the ground that the subject matter of the writ petition itself has become infructuous in view of de-linking of post from the selection post to that of promotional post. It is thus, stated that the relief obtained by him in O.A.No.2102 of 1995 by order dated 8-22001, which was not implemented itself has become infructuous. Therefore, he seeks permission to withdraw O.A itself.

Accordingly, we dispose of the writ petition permitting the 1^st respondent herein to withdraw O.A.No.2102 of 1995, on the file of the A.P. Administrative Tribunal. Thus, it is made clear that as the O.A itself is withdrawn, obviously the order dated 8-2-2001 passed by the Tribunal in O.A.No.2102 of 1995 has become infructuous. Consequently, the WPMP.No.857 of 2012 stands dismissed. However, it is open for the 1^st respondent herein to approach appropriate forum for reddressal. No costs.
