The petitioner claims title and possession in respect of Ac.6.04 cents of land situated in survey No.386 of Vempalli village and Mandal of Kadapa District. It is stated that the petitioner’s grandfather purchased the said property for a valuable consideration under a registered sale deed dated 19.03.1925 and since then they have been continuing in possession and enjoyment of the same. It is alleged that the 4th respondent herein- a Zilla Parishad High School, has been using the petitioner’s land as play ground and has illegally constructed a boundary wall around the said land. On a representation made by the petitioner complaining about the illegal action of the 4th respondent, the 2nd respondent directed the petitioner to submit his title deeds. However, no further action is taken to get the compound wall removed. There is no response even to the legal notice dated 05.01.2012 got issued by the petitioner. Hence, the present writ petition seeking a declaration that the action of the respondents in not getting the compound wall constructed by the 4th respondent removed, is arbitrary and illegal.
