The Commissioner, Tirupathi Municipal Corporation, questions the order of the Andhra Pradesh Administrative Tribunal, Hyderabad, dated 27-10-2010, in O.A.No.12789 of 2009 in allowing the said O.A. filed by the respondents for grant of annual grade increments to them in the time scale wherein their pay was fixed and also to pay the arrears and further, to extend the benefit of pay revision made in 2005.
2. The said O.A. was disposed of as covered by the earlier order in O.A.No.7915 of 2002, which was upheld by a Division Bench of this Court in W.P.No.27214 of 2005, dated 23-8-2006.
3. It is stated that in fact, subject matter of this writ petition is squarely covered by a common order passed by a Division Bench of
this Court in W.P.No.24130 of 2011 and batch, dated 30-8-2011, which was also upheld by the Supreme Court of India in Special Leave to Appeal (Civil) Nos.29963-29965 of 2011, dated 14-11-2011. It is stated that the respondents herein were appointed on various dates during the year 1992-93 and they are being paid minimum time scale but periodical increments were not extended. It is further stated that in fact, the Commissioner, Municipal Corporation, Tirupathi, vide his letter in Roc.No.3467/2004/F2, dated 06-12-2010, sought for necessary instructions for implementing the orders.
4. As the issue raised in this writ petition is squarely covered by the aforesaid judgment of the Division Bench of this Court, this writ petition is dismissed.
5. In view of disposal of the writ petition, W.P.M.P.No.4889 of 2012 also stands dismissed. No costs.
