By this writ petition, the petitioner contends that his sons namely Praveen Kumar Tripati, aged 28 years, and Vikram Kumar Tripati, aged 30 years, R/o 5-4-52/50, Kannayalal street, Ranigunj, Secunderabad, are illegally detained by the respondents and he seeks direction to the respondents to produce his sons before this Court and to set them at liberty.
The 3rd respondent-Inspector of Police, Central Crime Station, Saroornagar, Cyberabad, filed detailed counter-affidavit, denying the allegations made by the petitioner, and it is stated that the alleged detenu viz., Praveen Kumar Tripati and Vikram Kumar Tripati are accused in Crime No.785 of 2011 on the file of Rajendranagar Police Station, Cyberabad, registered for the offences punishable under Sections 454, 380 and 411 of I.P.C. and they were arrested on 10.02.2012 in connection with the said crime and produced before the VIII-Metropolitan Magistrate, Cyberabad at Rajendranagar, on 11.02.2012, who remanded them to judicial custody. It is further stated that pursuant to the remand order, the alleged detenu are now lodged at Central Prison, Cherlapally, Ranga Reddy District.
Heard Sri P.K.Krishnaiah, learned Counsel for the petitioner and learned Advocate General appearing on behalf of respondents 1 to 3.
In view of the averments of the counter-affidavit of the 3rd respondent, it is apparent that the alleged detenu are the accused in Crime No.785 of 2011 and in that connection they have been arrested and sent to remand and therefore the question of illegal detention does not arise. Hence, this Court is of the view that no orders need be passed in the present writ petition.
The Writ Petition is accordingly closed. No order as to costs.
